Mr. Nelson provided a recap of the first public hearing for the item, which took place during the October 26 Planning and Zoning Commission meeting. During the hearing, Mr. Logan Clark of Moore Bass Consulting, representing the applicants, spoke in favor of granting the request. No one present spoke in opposition to the application. Following the public hearing, the Planning and Zoning Commission voted 4-0 to recommend that City Council approve the Conditional Use Permit.

Mr. Nelson stated that the request is consistent with the Forsyth Zoning Ordinances, as well as the Comprehensive Plan and Future Land Use Map. He also presented a letter from Mr. Andrew Newton, representing Mr. George Emami as President of the Fox Run Homeowners Association, which stated that the HOA covenants do not allow the lease of a portion of property. Mr. Nelson advised that the applicant has stated that the apartment is to be used for family and HOA Covenants may be stricter than City regulations, but it is the responsibility of the HOA to enforce those private covenants.

Mrs. Ashley Altman, the applicant, spoke in favor of granting the request. She stated that the accessory dwelling unit is intended to serve as an in-law suite for her parents in the future.
